I have a wide-ranging litigation practice with an emphasis on business and appellate matters. Regardless of the type of case or the scale of the problem, I start by looking at the big picture and identifying an efficient and effective path to my client’s objective. I am not afraid to use strategies or make arguments that are outside of the box if they serve my client’s goals. I understand what is important to judges, arbitrators, and other decisionmakers, and I work hard to present my clients’ perspectives in a clear, concise, and persuasive manner.

I regularly represent clients, including businesses, their owners, and their officers, in matters involving breaches of contracts, ownership disputes, minority-shareholder oppression claims, trade secrets, intellectual property, noncompete agreements, and employment issues. I serve as local counsel to national and multinational corporations in sophisticated litigation in Michigan state and federal courts.

I also work with whistleblowers in False Claims Act qui tam claims to recover stolen government money. I have successfully represented numerous clients who have uncovered healthcare and other fraud schemes perpetrated against the federal government and state governments. These cases have recovered millions of dollars of misappropriated government funds and yielded significant awards for the whistleblowers.

Additionally, I have successfully represented numerous clients in appeals in state and federal courts. I have pursued and defended appeals involving diverse issues from business disputes to domestic-relations cases to medical-malpractice actions. Whatever the case may be, my goal is always to reach an optimal result based on pragmatic and efficient representation.

Examples of Excellence

  • Represented members of a medical billing entity in a False Claims Act qui tam case against a physician regarding fraudulent Medicare and Medicaid billing that resulted in the recovery of over $23 million of government funds.
  • Successfully defended an investment advisor in a federal injunction proceeding brought by his former employer, ultimately leading to the resolution of all claims against him.
  • Obtained full pre-discovery dismissal of allegations of copying brought against an artist by a competitor and subsequently persuaded the court to order the competitor reimburse my client for all of his attorney fees incurred in the action.
  • Represented employees of a community housing organization in a False Claims Act qui tam case against a contractor that resulted in the recovery of over $1,000,000 of government money that the contractor fraudulently obtained through government energy programs.
  • Defended the majority members of an LLC that owns a shopping mall against oppression claims brought by a minority member and negotiating the purchase of the minority member’s interest.
  • Represented the seller of a pharmacy in obtaining a judgment in excess of $1 million, plus reimbursement of attorney fees, against the purchaser where the purchaser breached numerous obligations under the purchase agreement by, among other things, using the pharmacy as part of a Medicare fraud scheme.
  • Filed a False Claims Act qui tam case against a medical practice on behalf of whistleblower nurse anesthetists that resulted in the recovery of over $600,000.00 of funds that were improperly billed to Medicare.
  • Persuaded the Michigan Court of Appeals to reverse a trial-court order assessing conversion treble damages and attorney fees against a national mortgage-servicing entity in a dispute over an insurance check.
  • Negotiated the reduction of a fine imposed by the State of Michigan against an insurance agent in a regulatory action alleging the unlicensed sale of unregistered securities to less than ten percent of the amount originally assessed.
  • Obtained the expungement of frivolous claims brought against an investment advisor from that advisor’s record over objections by the advisor’s former client.
  • Negotiated a favorable settlement on behalf of a condominium owner requiring that her association complete significant repairs to her unit after the association delayed in responding to repeated maintenance request and changed its bylaws to avoid completing the maintenance.
  • Obtained numerous judgments correcting title defects on behalf of several national lending institutions and title insurance companies.
  • Obtained numerous successful appellate results affirming favorable rulings on dispositive motions for Hertz Schram clients.
